Preamble
The present General Terms and Conditions of Sale (GTCS) apply to all sales of products or services made by E-newcademy, a one-person simplified joint stock company (SASU) registered with the Registre du Commerce et des Sociétés under the SIREN number 930000443, whose registered office is located at 66 AVENUE DES CHAMPS ELYSEES, 75008 PARIS, hereinafter referred to as “the company”, to its customers, hereinafter referred to as “the customer”. E-newcademy is a website that connects learners with institutions offering online courses.
Scope of application
These GTC apply to all sales of products or services made by the company, whether the sale is made on the company’s website or by any other means.
Orders
Orders may be placed by the customer via the company’s website or by any other means made available by the company. The order is deemed accepted by the company upon receipt of the order confirmation by the customer.
Orders from affiliated platforms
E-newcademy presents programs from affiliated platforms and schools. E-newcademy is solely responsible for promoting these courses. Legal and commercial responsibility for orders placed with these platforms lies directly with them, and not with E-newcademy itself. However, customers have the opportunity to report abuse so that E-newcademy takes this into account and does everything necessary to present reliable and quality content.
Prices
The prices of products and services are quoted in euros, inclusive of all taxes. The following payment methods are accepted: Paypal, Stripe and credit cards. Payments can be made by immediate payment, by bank transfer or by deferred payment.
Delivery
Programs purchased via E-newcademy are available online on our platform. Once a course has been purchased from one of our direct partners (excluding affiliates), E-newcademy and/or the partners undertake to provide the necessary access as quickly as possible, so that the learner can quickly access the program. Access methods and deadlines are specified at the time of purchase.
Receipt and complaints
The customer must check the conformity of the products or services delivered with the order. In the event of non-conformity, the customer must inform the company within 15 days for courses of less than 15 days and 30 days for courses of more than 30 days from receipt of the products or services.
Returns and refunds
The customer has 14 days from receipt of the products or services to exercise his right of withdrawal. Products or services must be returned in their original condition and complete. The right of withdrawal for consumers is 14 days from receipt of the products or services, in accordance with article L. 221-18 of the French Consumer Code. This period allows consumers to change their mind and return products or services without having to justify their decision. Reimbursement will be made within a maximum of 15 days from receipt of the returned products or services.
Warranties
Products or services sold by the company benefit from the legal guarantee of conformity and the legal guarantee against hidden defects. In addition :
A 15-day guarantee from the time of purchase and the start of the online program applies to training courses lasting less than 30 days.
A 30-day guarantee applies to online training courses lasting more than 30 days.
These guarantees come into effect when less than 50% of the program has been completed, and there is no program completion, certificate or diploma obtained.
Please note that no refunds will be made after the guarantee expires, and that E-newcademy cannot be held responsible.
For E-newcademy partners (not affiliated), the anti-guarantee is effective. The percentages due to each party (i.e. E-newcademy and the school) will be paid once the purchase of the course has been definitively concluded, after the end of the guarantee period. E-newcademy will never solicit direct payments from partner schools; the only payments made are the shares linked to course sales, managed directly in the system.

Liability
The company cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party. The company cannot be held responsible for the content of online courses provided by partner establishments. E-newcademy’s liability includes :
Compliance with warranties and withdrawal rights.
Respect for the faithful, transparent and authentic presentation of the courses and schools presented on the website, including crucial information such as accreditation, recognition, prices, payment terms, the program and its opportunities, as well as the identity of the school.
Intellectual property rights
All elements of the company’s website are and remain the exclusive intellectual property of the company. On-line courses are the intellectual property of partner establishments and are protected by intellectual property laws.
Copyright on photos used
Certain images and photos have been used on the site with the consent of the authors, free of charge in exchange for credit for the works. We would like to thank the authors and the sites for making their works available free of charge:
Some images are original works created by E-newcademy. In the event of disagreement or oversight regarding the crediting of works offered and protected, you can always contact E-newcademy to request a correction and update.
Personal data
Personal data collected by the company is processed in accordance with the company’s privacy policy.

Terms and conditions of use
E-newcademy is an intermediary that promotes and sells higher education institutions’ online courses to learners. The company receives commissions on sales.
For learners
Learners must register to access content, additional services and purchases on E-newcademy. Learners who purchase online courses via E-newcademy benefit from additional services such as an AI tutor, an online library or 3 months’ personalized support, depending on the formulas and types of courses purchased.
For schools
Schools must first make an appointment with E-newcademy to discuss terms and conditions. E-newcademy verifies state recognition and accreditation of courses before promoting them. Once membership has been approved, an E-newcademy marketplace account is created for the school to sell its courses. E-newcademy checks and approves courses before they are distributed.
Duration and termination
There is no subscription and access to services is free. Learners benefit from a 30-day guarantee for courses longer than 30 days and a 15-day guarantee for courses shorter than 15 days. For schools, E-newcademy applies an “anti-guarantee”: they only pay E-newcademy once the sale has been fully concluded after the guarantee period.
Cancellation conditions
There are no specific cancellation conditions, except for the guarantees mentioned and the possibility of deleting your account. Beyond the guarantees, cancellation must be made directly with the school, according to its policy. Partner schools wishing to terminate their partnership contracts with E-newcademy may do so in accordance with the clauses of the contract.
Obligations of the parties
Customer obligations
The customer undertakes to comply with the terms of use of the services, to make payments on time and not to use the services for illegal purposes.
Learners
Learners are required to respect certain rules when using E-newcademy services and those of their partners:
-Respect for course copyrights.
-Account confidentiality: do not divulge your account password, and access E-newcademy services only on a personal basis.
-Never provide links or content requiring prior purchase to people who have never accessed these services, as this is E-newcademy property made available to its customers.
-Learners must remain courteous and respectful towards E-newcademy members such as site employees, partner schools and other learners.
-If any problems are encountered, learners should report them to support, so that we can guarantee the best possible service.
Partner school
Account confidentiality: information such as passwords is confidential and can only be accessed by authorized members of the school. The school must make every effort to ensure the confidentiality and security of its account, so that no external member can access it.
Schools are required to be transparent, fair, ethical and authentic in the description of their programs and the delivery of courses to learners. In the event of any concerns or changes, we invite schools to contact E-newcademy as soon as possible.
In the event of any problems, schools are asked to report them to support, so that we can guarantee them the best possible service.
Schools must remain courteous and respectful towards E-newcademy members such as site employees, partner schools and other learners.
Generally speaking, breaches of these obligations may result in warnings, temporary exclusions, permanent exclusions or even legal action on a case-by-case basis.
Company obligations
The company undertakes to provide the services in accordance with these GCS and to provide adequate technical support. We undertake to be transparent about information relating to online courses.
Confidentiality and security
The company implements security measures to protect customer data. Information exchanged between the customer and the company is confidential and will not be disclosed to third parties without the customer’s prior consent.
Disputes and mediation
In the event of a dispute, the parties agree to seek an amicable solution. Failing this, the dispute will be submitted to mediation. The mediator’s contact details are available on the company’s website. You can also contact support directly by e-mail using the contact form.
Applicable law and jurisdiction
These terms and conditions are governed by French and European law. In the event of a dispute, the courts of Paris shall have exclusive jurisdiction.
Miscellaneous provisions
The company reserves the right to modify these GTC at any time. The invalidity of any clause in these GTC shall not invalidate the other clauses. The fact that the company does not avail itself of a breach by the customer of one of the obligations in these GTC shall not be construed as a waiver of the obligation in question.
Affiliation and commissions
E-newcademy is affiliated with certain platforms to sell their courses under an affiliation contract. These platforms have partner schools but need development. E-newcademy receives commissions on sales made via these platforms.
E-newcademy also sells the courses of partner schools directly to our company. In this case, E-newcademy acts as a direct intermediary, and receives commissions on sales.
