E-newcademy acts as an intermediary allowing institutions (schools, universities, training providers, etc.) to offer their online courses (certificates, diplomas, microcredentials, etc.) to potential buyers.

By accessing and using the Site, Users unconditionally accept these Terms.

2.1 Account Review and Management

We conduct a daily and meticulous review of all created accounts to ensure their authenticity and compliance with our platform’s Terms.

Upon account creation, it is possible that:

• A validation by an administrator is required before granting full access to the platform’s features.
• Users may receive an additional confirmation request to validate their account.
• In accordance with our account management policy and the General Data Protection Regulation (GDPR), if a user account is identified as spam or remains inactive for 30 days without activation, it will be automatically deleted.
• We reserve the right to immediately delete any accounts identified as spam without delay.

In the event of an error or a dispute regarding account deletion, Users must contact support for further review.

2.2 Services offered

E-newcademy enables institutions (hereinafter “Sellers”) to publish online courses and sell them to end users (hereinafter “Buyers”). Courses may take the form of certificates, diplomas or microcredentials, among others.

A. Registration of Sellers and Buyers

• Sellers must be recognized educational institutions (schools, universities, etc.).
• Buyers must register by creating an account on the Site to access the courses available for sale.

3. Access and registration

A. Site access

Access to the Site is free for any User with an Internet connection. However, certain functionalities (purchase of courses, publication of courses for Sellers) require prior registration.

B. Registration

• Registration is free and open to any individual or legal entity wishing to buy or sell courses on the platform.
• The information provided at the time of registration must be accurate and up to date.
• The User is responsible for the confidentiality of his/her account and password. Any activity carried out via his account is his responsibility.

4. Use of services

A. Sellers’ obligations

• Sellers must guarantee the accuracy and legality of the information relating to the courses they publish.
• They must ensure that the courses offered comply with the laws in force and that they hold all the necessary rights to market them.
• Sellers are responsible for managing transactions, ensuring the quality of courses and issuing certificates or diplomas.

B. Obligations of Buyers

• Buyers must ensure that they meet the prerequisites for enrolling in the courses purchased.
• They must respect the specific terms and conditions of the courses offered by the Sellers.

5. Responsibility of E-newcademy

E-newcademy acts as an intermediary and is not responsible for the content provided by the Sellers or for the quality of the courses. In the event of a dispute between a Seller and a Buyer, E-newcademy may act as a mediator but declines all responsibility for the outcome of the dispute.

A. Site availability

E-newcademy undertakes to provide continuous access to the Site, subject to possible interruptions for maintenance, updates or causes beyond its control.

B. Limitation of liability

E-newcademy shall not be held liable for any direct or indirect damage resulting from the use of the Site, in particular in the event of loss of data, viruses or technical malfunctions.

6. Protection of personal data

7. Intellectual property rights

8. Payments and refunds

Financial transactions on the Site are handled by secure third-party payment providers. E-newcademy is not responsible for any errors or fraud related to payments made via these service providers.

A. Refunds

Refund conditions are set by each Seller. E-newcademy offers a money-back guarantee ranging from 14 to 30 days for Buyers subject to the specific terms of each course.

9. Account cancellation

E-newcademy reserves the right to suspend or terminate an account in the event of non-compliance with these GCU, fraudulent or illicit behavior, or for any other reason deemed valid by the platform.

10. Modification of the GCU

E-newcademy reserves the right to modify these GTU at any time. Modifications will take effect as soon as they are published on the Site. It is the Users’ responsibility to regularly consult the updated GTU.

11. Applicable law and jurisdiction

These GCU are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution before resorting to the competent courts of Paris, France.
